These Terms govern your use of mageelighting.com and quote.mageelighting.com (the "Site"). By using the Site, you agree to them. If you do not agree, please do not use the Site.
These Terms are not the contract for lighting work. If you hire us, the work is governed by our Service Agreement, which you receive with your Proposal and accept by paying your invoice. If these Terms conflict with the Service Agreement, the Service Agreement controls for anything relating to the work.

The Site describes our services, packages, and pricing. Everything on it is provided for general information.
Prices on the Site are estimates and are not offers. Package names, contents, and prices shown on the Site are drawn from our live catalog and can change at any time without notice. The only price that binds either of us is the price stated in the written Proposal we send you.
Photographs on the Site show past work. Your display will be designed for your property and will not be identical.
Submitting the quote form or the contact form does not create a contract, does not reserve an install date, and does not obligate either of us to anything. It is a request for us to prepare a Proposal. We may decline any request.
You agree that the information you give us is accurate and that you have the authority to request work at the address you provide.
When you give us your phone number or email address, you agree that we may contact you about your request and your project. This includes quote confirmations, invoices and payment reminders sent through Square, scheduling and install-day messages, preparation instructions, and service notices.
Marketing email is separate. Every marketing email includes an unsubscribe link. See our Privacy Policy.

The Site and its contents, including text, photographs, video, designs, layouts, graphics, and our name and logo, are owned by Magee Lighting, LLC or our licensors and are protected by copyright, trademark, and other laws.
You may view and print pages for your own personal, non-commercial use in connection with considering or purchasing our services. You may not otherwise copy, reproduce, republish, distribute, or create derivative works from Site content without our written permission.
Reviews and testimonials on the Site are reproduced from their original sources and belong to the people who wrote them.
If you send us ideas or suggestions about our business or the Site, you agree we may use them without obligation or compensation to you.
The Site links to and relies on third-party services, including Square for payments, Google for scheduling and email, Netlify for hosting, and social media platforms. Their terms and privacy policies govern your use of them. We are not responsible for third-party content or practices.
THE SITE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that the Site will be uninterrupted, error free, secure, or that the information on it is current, complete, or accurate. Catalog prices and availability can be out of date.
This Section does not limit any warranty we give you in the Service Agreement for work we actually perform.
TO THE FULLEST EXTENT PERMITTED BY LAW, MAGEE LIGHTING WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING OUT OF YOUR USE OF THE SITE, AND OUR TOTAL LIABILITY ARISING OUT OF YOUR USE OF THE SITE WILL NOT EXCEED ONE HUNDRED DOLLARS ($100).
This limit applies to your use of the Site only. Our liability for work we perform is governed by the Service Agreement.
Nothing in these Terms limits liability for bodily injury or death caused by our negligence, for fraud, or for anything else that cannot be limited under Georgia law. Nothing in these Terms limits your rights under the Georgia Fair Business Practices Act or any other consumer protection law that cannot be waived.
You agree to indemnify and hold Magee Lighting harmless from claims arising out of your violation of these Terms, your misuse of the Site, or information you submit that is false or that you were not authorized to provide.
We may change these Terms at any time by posting an updated version here and changing the "Last updated" date. Your continued use of the Site after that means you accept the change. Changes do not apply retroactively to a Proposal you have already accepted.
We may also change, suspend, or discontinue any part of the Site at any time.
Georgia law governs these Terms, without regard to conflict of laws rules. The state and superior courts of Fulton County, Georgia have exclusive jurisdiction, except that either party may bring a qualifying claim in the Magistrate Court of Fulton County (small claims).
If any provision of these Terms is unenforceable, it is modified to the minimum extent needed to make it enforceable, or severed, and the rest stays in effect. Our failure to enforce a provision is not a waiver of it. These Terms, together with the Privacy Policy and, if you are a customer, the Service Agreement, are the entire agreement between us about the Site.
